§1 Definitions

  • Consumer Rights Act – the Act of May 30, 2014, on consumer rights.
  • Civil Code – the Act of April 23, 1964 – Civil Code.
  • GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.
  • Privacy Policy – a document specifying the rules for processing personal data by the Service Provider within the Platform.
  • Materials – texts, graphics, logos, algorithms, AI models, visual elements, and source code published within the Platform.
  • Platform – the online service available at doestimate.com.
  • Form – a tool available within the Platform enabling the submission of a functional design in order to generate an estimated Smart Home installation quote.
  • Functional Design – a horizontal floor plan of a building (floor plan view) containing the layout of rooms and information about their areas (square footage), submitted by the User for analysis.
  • Estimate – a system-generated approximate overview of the scope and indicative price of a Smart Home installation.
  • Computer Vision – image processing techniques using artificial intelligence algorithms for automatic recognition of elements within a functional design.
  • Artificial Intelligence (AI) – machine learning systems and models, including large language models (LLMs), Computer Vision models, and the Service Provider's proprietary models, used for analysing functional designs and generating Estimates.
  • External Systems – third-party services and infrastructure used by the Service Provider for data processing, including services provided by Google, OpenAI, Anthropic, and other AI and cloud platforms.
  • Personal Data – information provided by the User in the Form, including first name, last name, email address, and phone number.
  • User – a natural or legal person using the Platform who is at least 16 years of age.
  • Consumer – a natural person using the Platform for purposes unrelated to business activity.
  • Entrepreneur – a natural person, legal entity, or organizational unit using the Platform in connection with business activity.
  • beAutomated – a brand owned by the Service Provider, under which Smart Home installation design and execution services are provided; owner of the doEstimate brand.
  • Service Provider – AWAREGROUP Sp. z o.o. based in Wroclaw, ul. Sw. Mikolaja 8/11 lok. 208, 50-125 Wroclaw, KRS: 0000966637, NIP: 9151821509, owner of the beAutomated and doEstimate brands.
  • Terms of Service – these terms and conditions for the provision of electronic services.

§2 General Provisions and Acceptance of Terms

  1. 1Use of the Platform, including the submission of a functional design through the Form, constitutes acceptance of these Terms of Service, the Privacy Policy, and the Cookie Policy.
  2. 2The User is required to read the Terms of Service before using the Platform.
  3. 3If the User does not accept these Terms of Service, they should immediately cease using the Platform.
  4. 4The Platform may only be used by individuals who are at least 16 years of age. Individuals under 18 years of age should use the Platform with the knowledge and consent of their legal guardian.
  5. 5The Service Provider provides services electronically in accordance with the Act of July 18, 2002, on the provision of electronic services.

§3 Nature of the Platform

  1. 1The doEstimate.com Platform is an online tool for generating preliminary, indicative Smart Home installation estimates.
  2. 2The Platform enables analysis of functional designs for: apartments, detached single-family houses, and semi-detached single-family houses.
  3. 3The Platform is not intended for the analysis of multi-family buildings, commercial premises, or industrial facilities.
  4. 4The Platform does not constitute an online store or an electronic sales system.
  5. 5No sales agreement or agreement for the delivery of digital content is concluded through the Platform.
  6. 6The Estimate is purely informational and illustrative. It does not constitute an offer within the meaning of Art. 66 of the Civil Code, a promise, a commitment, or a price guarantee.
  7. 7The final price and scope of installation require individual verification and confirmation by the beAutomated team.
  8. 8The Estimate is generated automatically by artificial intelligence systems and is not subject to human review before being delivered to the User.

§4 Requirements for the Functional Design

  1. 1In order to correctly generate an Estimate, the User is required to submit a complete functional design.
  2. 2The functional design should include a legible horizontal floor plan with room labels and information about room areas (square footage).
  3. 3Missing area information, missing room labels, or an illegible design may result in an incorrect Estimate.
  4. 4The Service Provider is not liable for errors resulting from the submission of an incomplete, illegible, or incorrect functional design.
  5. 5The User is solely responsible for removing or anonymising any third-party personal data contained in the submitted functional design (e.g., names, addresses, plot numbers, designer contact details).
  6. 6The Service Provider implements technical measures aimed at automatically detecting and anonymising personal data within submitted functional designs; however, the effectiveness of such mechanisms is not guaranteed. The ultimate responsibility for anonymising third-party personal data lies with the User.

§5 Rules for Using the Form

  1. 1The User may generate a maximum of 3 Estimates free of charge.
  2. 2After exceeding the free Estimate limit, further use requires individual contact with the Service Provider.
  3. 3The User submits the functional design voluntarily and declares that they have the right to use it and that they hold the necessary consents or authorisations to share the data contained therein.
  4. 4The system analyses the functional design using Computer Vision techniques, artificial intelligence algorithms, large language models (LLMs), and the Service Provider's proprietary models.
  5. 5The system automatically recognises data from the functional design, including in particular the room layout, their purpose, and areas.
  6. 6The User is required to verify the data read by the system before confirming the Estimate. Confirmation of the data by the User constitutes acceptance of its accuracy.
  7. 7Once the User confirms the data, the Estimate is sent to the specified email address.
  8. 8The User provides their personal data (first name, last name, email address, phone number) in the Form voluntarily and declares that the data provided is truthful and current.

§6 Licence for Submitted Materials

  1. 1By submitting a functional design through the Form, the User grants the Service Provider a non-exclusive, royalty-free, sublicensable licence to process, analyse, store, and use the submitted functional design for the following purposes: (a) generating the Estimate, (b) improving and developing algorithms, AI models, and Platform mechanisms, (c) statistical and qualitative analysis in anonymised form.
  2. 2The Service Provider implements technical measures aimed at anonymising data before using it for system improvement purposes; however, the full effectiveness of anonymisation mechanisms is not guaranteed.
  3. 3The User represents and warrants that they are authorised to grant the above licence and that the submitted materials do not infringe any third-party rights, including copyrights, personality rights, or trade secrets.
  4. 4Submitted functional designs are stored for a period of 1 (one) year from the date of submission, after which they are permanently deleted from the Service Provider's systems.
  5. 5The User's personal data (first name, last name, email address, phone number) is stored in accordance with the periods specified in the Privacy Policy.
  6. 6The Service Provider does not acquire copyright to submitted functional designs. Intellectual property rights to the functional design remain with the User or the authorised third party.

§7 Liability and Exclusions

  1. 1Estimates are generated automatically based on data read from the functional design by artificial intelligence systems, without human verification.
  2. 2Computer Vision algorithms, LLM models, and the Service Provider's proprietary models may misinterpret elements of the functional design, in particular areas, room labels, floor levels, room purposes, or other technical data.
  3. 3The Service Provider does not guarantee full accuracy of the data read by the system against the actual building parameters.
  4. 4The Service Provider is not liable for investment, construction, design, or any other decisions made on the basis of an Estimate.
  5. 5The Estimate is indicative and does not constitute a binding price offer, cost estimate, technical design, or document of legal value.
  6. 6A final quote requires technical analysis and confirmation by the beAutomated team.
  7. 7The Service Provider is not liable for direct or indirect damages, lost profits, data loss, moral damages, or business consequences arising from the use of an Estimate or the Platform.
  8. 8To the maximum extent permitted by law, the Service Provider's liability towards Entrepreneurs is excluded.
  9. 9With respect to Consumers, to the maximum extent permitted by Polish and European Union law, the Service Provider's liability is limited to damages caused by wilful misconduct.
  10. 10The Service Provider is not liable for data submitted through the Form that constitutes part of the functional design. Such data is processed by external systems, including LLM (Large Language Model) models, Computer Vision systems, Machine Learning mechanisms, and the Service Provider's proprietary models enriched with external AI solutions. The Service Provider assumes no responsibility for the processing of such data within the external systems it utilises.
  11. 11Personal data processed by the Service Provider within its own systems, such as first name, last name, phone number, and email address, is appropriately secured. Communication between the doEstimate Platform and the User is encrypted using the SSL/TLS protocol.
  12. 12The Service Provider is not liable for the content of submitted functional designs, including any infringement of copyrights, personality rights, or other third-party rights by the User.
  13. 13The Service Provider uses third-party services (including Google, OpenAI, Anthropic, and other AI providers) for data processing. The Service Provider is not liable for the acts, omissions, failures, errors, or security breaches of such third parties.
  14. 14The provisions of this section do not limit Consumer rights arising from mandatory provisions of Polish law and European Union law, including the Consumer Rights Act and Directive 93/13/EEC on unfair terms in consumer contracts.

§8 Platform Availability

  1. 1The Platform is provided on an "as is" and "as available" basis, without any warranties, express or implied.
  2. 2The Service Provider does not guarantee uninterrupted, error-free, or fault-free operation of the Platform.
  3. 3The Service Provider reserves the right to temporarily suspend the operation of the Platform for maintenance, updates, or modernisation purposes, without prior notice to Users.
  4. 4The Service Provider is not liable for damages resulting from the unavailability of the Platform, interruptions in its operation, data loss, or processing delays.
  5. 5The Service Provider reserves the right to modify, limit, or discontinue the services provided through the Platform at any time.
  6. 6The provisions of this section do not exclude or limit the Service Provider's liability towards Consumers to the extent required by mandatory provisions of applicable law.

§9 Force Majeure

The Service Provider shall not be liable for failure to perform or improper performance of obligations under these Terms of Service if such failure is caused by force majeure, i.e., extraordinary, external events that are unforeseeable or unavoidable, including but not limited to: natural disasters, wars, acts of terrorism, pandemics, strikes, failures of telecommunications or energy infrastructure, cyberattacks, decisions of public authorities, failures of third-party systems (including cloud and AI service providers), and other events beyond the Service Provider's control.

§10 Prohibited Conduct

  1. 1The User agrees to use the Platform in accordance with its intended purpose, applicable law, and these Terms of Service.
  2. 2The following is prohibited in particular: (a) submitting content that is unlawful, offensive, or infringes third-party rights, (b) automated data extraction from the Platform (scraping, crawling), (c) attempting to circumvent the Platform's technical security measures, (d) impersonating other persons or providing false data, (e) using the Platform in a manner that may disrupt its operation or cause damage to the Service Provider or other Users, (f) reverse engineering, decompilation, or disassembly of Platform systems.
  3. 3In the event of a breach of the above rules, the Service Provider reserves the right to immediately block the User's access to the Platform, delete submitted data, and take appropriate legal action.
  4. 4The Service Provider reserves the right to restrict or block access to the Platform for any User who violates these Terms of Service, without prior notice.

§11 Commercial Use of the Platform

  1. 1The Platform is intended for individual use.
  2. 2Using the Platform to serve clients, prepare commercial offers, or in the course of business activity requires prior contact with the Service Provider.

§12 Payments

As of the effective date of these Terms of Service, use of the Form and generation of Estimates is free of charge. The Platform does not support online payments.

§13 Intellectual Property

  1. 1All rights to the Platform, including its algorithms, AI models, proprietary models enriched with external solutions, Computer Vision mechanisms, calculation structure, and Materials, belong to the Service Provider.
  2. 2The User does not acquire any rights to the technology, models, or operation of the Platform.
  3. 3Copying, decompiling, analysing, or using the Platform's mechanisms for competitive purposes is prohibited.
  4. 4All trade names, logos, trademarks, and graphic elements of the Platform are protected by intellectual property law and may not be used without the Service Provider's written consent.

§14 Personal Data Protection

  1. 1The Service Provider is the Administrator of Users' personal data within the meaning of GDPR.
  2. 2Data is processed in accordance with GDPR, the Act of May 10, 2018, on the protection of personal data, and the Privacy Policy, which constitutes an integral part of these Terms of Service.
  3. 3Submitted functional designs may be processed automatically by artificial intelligence systems, including external systems, for the purpose of generating an Estimate and improving the Platform's algorithms.
  4. 4The Service Provider informs that data submitted through the Form may be transferred for processing to third parties, including AI service providers (Google, OpenAI, Anthropic), whose servers may be located outside the European Economic Area (EEA). Data transfers are carried out on the basis of appropriate legal safeguards, including Standard Contractual Clauses (SCCs) or adequacy decisions.
  5. 5Detailed information regarding the processing of personal data, including a list of data processors, data retention periods, User rights, and rules for transferring data to third countries, is contained in the Privacy Policy.
  6. 6The Service Provider may be contacted regarding personal data protection matters at: contact@doestimate.com.

§15 User Liability and Indemnification

  1. 1The User bears full responsibility for the content of submitted functional designs and the truthfulness of provided personal data.
  2. 2The User agrees to indemnify and hold the Service Provider harmless from any and all third-party claims arising from: (a) submission of a functional design that infringes copyrights, personality rights, or other third-party rights, (b) submission of third-party personal data without the required consent or legal basis, (c) use of the Platform in a manner inconsistent with the Terms of Service or applicable law.
  3. 3If the Service Provider incurs damages or is charged with penalties, fines, or costs as a result of the User's actions in breach of the Terms of Service or applicable law, the User agrees to fully cover such costs.
  4. 4The User acknowledges that the Estimate is generated automatically by AI systems and accepts all risks associated with inaccuracies, incompleteness, or errors in the generated Estimate.
  5. 5Provisions 2 and 3 of this section apply exclusively to Entrepreneurs. With respect to Consumers, liability is determined in accordance with mandatory provisions of Polish and European Union law.

§16 Final Provisions

  1. 1These Terms of Service are effective from 22.02.2026.
  2. 2In matters not regulated by these Terms of Service, the provisions of Polish law shall apply, including the Civil Code, the Consumer Rights Act, the Act on the provision of electronic services, and GDPR.
  3. 3The Service Provider reserves the right to amend these Terms of Service. The Service Provider shall notify of changes by publishing a new version of the Terms of Service on the Platform together with the effective date of the changes, with at least 14 days' advance notice. Continued use of the Platform after the effective date of the amended Terms of Service constitutes acceptance of the changes. A Consumer who does not accept the changes has the right to cease using the Platform before the effective date of the changes.
  4. 4If any provision of these Terms of Service is found to be invalid or unenforceable by a competent court or authority, the remaining provisions shall remain in full force and effect (severability clause).
  5. 5In disputes with Entrepreneurs, the competent court shall be the court in Wroclaw.
  6. 6Consumers may use out-of-court dispute resolution methods in accordance with applicable regulations, including through the ODR (Online Dispute Resolution) platform available at: https://ec.europa.eu/consumers/odr/.
  7. 7These Terms of Service are drawn up in Polish. In the event of any discrepancy between the Polish version and translations into other languages, the Polish version shall prevail.
  8. 8Failure by the Service Provider to enforce any provision of these Terms of Service shall not constitute a waiver of the right to enforce such provision in the future.
